  • Penny provides an AI-powered platform for discovering, analyzing, and transacting hotel investment properties worldwide.
  • Our services include property search, market intelligence, investment analytics, due diligence resources, and broker connectivity.
  • Penny acts as a technology platform and marketplace. We are not a licensed broker-dealer, investment advisor, or real estate agent unless explicitly stated.

3. Account Registration

  • You must create an account to access certain features of the platform. You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must be at least 18 years of age and have the legal capacity to enter into these terms.
  • We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Property Listings & Information

  • Property listings on Penny are provided by third-party sellers, brokers, and data providers. While we strive for accuracy, Penny does not guarantee the completeness or accuracy of any listing information.
  • All property information, including pricing, financial projections, and market data, is provided for informational purposes only and should not be relied upon as the sole basis for investment decisions.
  • Users are responsible for conducting their own independent due diligence before making any investment decisions.
  • AI-generated valuations, projections, and recommendations are estimates based on available data and should be verified independently.

5. Intellectual Property

  • The Penny platform, including its design, features, AI models, analytics tools, and content, is the intellectual property of Penny Hotels & Investments.
  • You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
  • You may not copy, modify, distribute, sell, or create derivative works based on our platform or content without prior written consent.

6. Prohibited Conduct

  • You may not use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Scraping, automated data collection, or reverse engineering of the platform is strictly prohibited.
  • You may not submit false or misleading information, including fraudulent property listings or investment claims.
  • Harassment, discrimination, or abusive behavior toward other users, brokers, or Penny staff will result in immediate account termination.

7. Limitation of Liability

  • Penny provides its services on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • In no event shall Penny be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
  • Our total liability for any claims related to the services shall not exceed the amount you paid to Penny in the twelve months preceding the claim.
  • Penny is not responsible for investment losses, transaction disputes, or the actions of third-party brokers and sellers.

8. Dispute Resolution

  • These terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions.
  • Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in New York, NY.
  • You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
